Article 1: Preamble

The purpose of these General Conditions of Sale (hereinafter referred to as the “CGV”) is to define the conditions under which the company SAMOPAR Société Anonyme with capital of 150,000 euros whose head office is 9 Avenue Albert II 98000 Monaco, registered in the Monaco Trade and Companies Register under number: RCI 76S01561, tel: 09 72 54 43 01, offers the marketing of products and services on its website accessible at the address www.lescopinesbio.com to its customers, individuals physical or moral. These General Terms and Conditions apply to all sales of  organic cosmetic products (hereinafter referred to as the “Product(s)”) and services (hereinafter referred to as the “Service(s)”). ) offered by organic friends to its customers. 

Any Order for Products and Services (as these terms are defined below) placed with SAMOPAR regardless of the means used, constitutes acceptance of these General Conditions of Sale. Any Order placed with “les allées Bio” is governed by these General Terms and Conditions. The SAMOPAR Company reserves the right to modify these General Terms and Conditions at any time. Any new version of these will be notified to the Customer prior to finalizing their order. The Customer who does not wish a sale of Products and Services offered by SAMOPAR to be governed by the new General Conditions of Sale, will refrain from placing a new order on the Website www.lescopinesbio.com 

It is established below that “les copines bio” means the site www.lescopinesbio.com of the company SAMOPAR

Article 2: Definitions

Definitions The following terms, whether used in the singular or plural in these General Terms and Conditions, will have the following definition:

  • Client: designates the natural or legal person contracting with Les Copines Bio under these General Terms and Conditions;
  • Order: designates the order(s) for Product(s) and/or Service(s) placed by the Customer with "les bandemies bio" following the terms provided for in Article 4.2 of these General Terms and Conditions ;
  • Personal account: designates the account created by the Customer on the Website and accessible by it using an identifier and a password;
  • Personal data(s): designate the personal data relating to Customers and collected by the company “Les allées bio” in the context of Orders placed on the Website;
  • Basket: designates the Order(s) awaiting confirmation, the Basket is attached to the Customer's Personal Account;
  • Product(s): refers to the products offered for sale on the Website;
  • Website: designates the website published by the company Samopar accessible at the address www.lescopinesbio.com;

Article 3: Navigation on the Website

3.1  The contents of the "Basket" can be consulted, by clicking on the corresponding icon, at any time during the completion of the Order and may be subject to modification by the Customer at any time during the order process and until payment of the current Order. Les Copines Bio also offers various Services to which the Customer can subscribe, associated or not with the Orders, namely: 

  • Sponsorship,
  • Loyalty program,

The conditions and terms of provision of these Services appear in the various sections provided for this purpose in the navigation of the Website and are subject, unless otherwise specified, to these General Terms and Conditions. 3.2 Presentation and essential characteristics of the Products and Services The Products and Services are offered on the Website in Metropolitan France in French. 

The essential characteristics of the Products and/or Services offered by "les Copines Bio" are described on the Website by clicking on each of the Products and/or Services. In this regard, "Les girlfriends Bio" indicates that the information mentioned on each tab entitled "Description" and/or "Use" and/or "Composition" and/or "Brands" are those communicated by the suppliers from whom the articles are acquired. “Les amis Bio” will make its best efforts so that, on the Site, the description and photographic representation of the Products is as faithful as possible to the Products.The products we offer are described and presented as accurately as possible. Despite all our precautions, inaccuracies, imprecisions or omissions may exist. “Les Copines Bio” cannot be held responsible for such inaccuracies, imprecisions or omissions. The photos are presented for information purposes only, they are not contractual.

Article 4: Conditions for completing an Order

4.1  Prior registration Prior to placing an Order, the Customer must register with Bio Santé Senior sarl on the website www.lescopinesbio.com and provide the information requested in order to create a Personal Account. The Client guarantees the accuracy, sincerity and reliability of the information provided. The Customer provides in particular a single valid and functional email address, which will be a means of communication between him and Bio Santé Senior sarl. 
It is therefore up to the Customer to modify any change of contact details at any time and as quickly as possible by connecting to their Personal Account. As a result, "les famille bio" cannot be held responsible for the Customer's lack of diligence in modifying and updating their contact details, and as a result of incorrect contact details, with their consequences on the delivery of the Products and/or or the provision of services. The company may check at any time the conformity of the information provided by the Customer and, where applicable, if this information appears to be erroneous and/or misleading, may request the communication of additional or corrected information. In the event of incorrect information or appearing misleading, 
the company reserves the right to terminate any contractual relationship with the Client and to suspend the latter's access to their Personal Account. Registration and creation of a Personal Account is subject to acceptance of these General Terms and Conditions. 4.2 The Customer has two options for placing an Order for Products and/or Services offered on the Website: 


  • on the Website by following the terms and processes indicated to it for this purpose during navigation,
  • by telephone (price of a local call) following the instructions of the contact person, by calling 09 72 54 43 01 . 

4.3  Prior to any Order, the Customer guarantees that he is of legal age, capable, and in particular authorized to use the means of payment that he will use to pay for his Order (credit card, check or bank transfer). 4.4 Orders placed on the Website can only be made for personal purposes as declared and acknowledged by the Customer. In this regard, "les famille bio" reserves the right to limit the number of Products ordered, too large a number of which would suggest commercial use of said products. In this regard, it is specified that les amis bio has General Conditions of Sale specific to the category of resellers. 4.5 


 Non-compliance by the Customer with all or part of the obligations subscribed to under these General Terms and Conditions, and in particular concerning any incident of payment of the price of an Order, may result in the suspension of access to the Services offered by "les famille organic", which will also benefit from the right to refuse any new Order to the customer. 4.6 Order Process on the Website The Customer has the possibility of ordering each Product and/or Service presented to him on the Website by following the following steps, for confirmation or refusal of which, the Customer is invited to click on the corresponding buttons: - Add to the Basket - Modify the Basket - Confirm the Order by accepting the T&Cs (Possibility to consult them) 

- Register as a new Customer or confirm your identity, (in particular the delivery address and billing address) - Confirm the Order - Pay for the Order on a secure HTTPS system which in this case is the system site payment provided by Paybox La Banque Palatine France . The Order will only be final from: - validation of its payment by the Customer if paying by credit card; - receipt of the check or bank transfer if the Customer prefers these means of payment. Gift vouchers, vouchers or other loyalty codes offered by “Les allées Bio” can be used by the Customer when paying for any Order. 4.7 


 Order Confirmation by “les bandemies Bio” 
Any Order placed by a Customer on the Website and/or by telephone is subject to immediate written confirmation from “Les bandemies Bio”, sent by email to the Customer . An email is also sent to the Customer to inform them of the shipment of the Order with a computer tracking number.

Article 5: Price of Products or Services – Regulations

5.1  The prices displayed on the Website for each Product or Service are indicated in euros, all taxes included (French VAT and other applicable taxes), excluding participation in preparation and shipping costs, such as these costs are specified in Article 8.3 below. In the event of an error in the price displayed on the Website, when preparing the Customer's Order, the lowest price will then be de facto applied to the Customer. 5.2 Payment of the amount of the Order can be made by credit card, check or bank transfer depending on the case. 

In this regard, it is specified that only payments in euros are accepted for the payment of an Order. Consequently, payments by transfer must be SEPA. Failing this, the Customer acknowledges that 3les Copines Bio" will under no circumstances have to bear the costs incurred during a transfer which has not been made in accordance with these provisions. Furthermore, payment by bank check is only possible for checks in euros drawn on a bank domiciled in France or Monaco. In the event of payment by check, the check is cashed upon receipt of the check. The check must be made out to the order of “Les amis bio Samopar” according to the details given for this purpose at the time of the choice of payment. 5.3 

 Any Order placed on the Website and delivered outside the euro zone may be subject to possible taxes and customs duties which are imposed when the package reaches its destination. These possible customs duties and taxes linked to the delivery of a Product are the responsibility and responsibility of the Customer. Products destined for the French Overseas Territories and Switzerland are invoiced excluding VAT by 'les Copines Bio' 

Article 6: Reservation of ownership

The Products delivered to the Customer remain the property of Bio Santé Senior sarl until the Customer has fulfilled all of its obligations towards “Les Comie Bio” Samopar, and in particular until full payment of the price of the Order, where applicable, plus late payment interest. In the event of a lack of sufficient monetary provisions when cashing the check or following the fraudulent use of a means of payment, “les famille bio” Samopar reserves the right to recover unpaid Products. 

Article 7: Product availability

Availability of Products At the time of his Order, in principle, the Customer can only order “les amis Bio” as having previously ensured their availability.
In the event of temporary unavailability, "les girlfriends bio" reserves an additional week for processing the order. 
If, despite the vigilance of "les girlfriends Bio", the items are unavailable, "Les girlfriends Bio" will inform the Customer by telephone and/or e-mail as soon as possible. 
The Customer then has the option: either to be delivered an item or service of equivalent quality and price, or to wait for the said product to be restocked with the possibility of having the available products delivered or to be reimbursed of the price of the Product or Service within 30 days of the Order. Reimbursement will be made, depending on the payment method chosen by the Customer, either by voucher or by credit to their bank account via the credit card used (payment for the order must have been made by CB and CB must still be valid), or by check issued in his name. 

Article 8: Preparation and delivery

8.1  Preparation and delivery times in mainland France Bio Santé Senior sarl offers for a large number of Products a preparation time of 48 hours from validation of the Order and a delivery time of 48 hours on average, a period within which the Customer is in principle delivered with your Order. However, "les famille bio" cannot be held liable in the event of exceeding this deadline to the extent that it remains less than the period of 30 days from the Order. 
The other delivery times are mentioned for information purposes only under the “Delivery” section of the Website and cannot be greater than the period of 30 days from the effective payment of the amount of the Order by the Customer, it being specified, however, that this period does not begins to run only from the day of receipt of the check, or receipt of the bank transfer. If the 30-day delivery period is exceeded, the Customer may cancel his Order. 

8.2  Delivery terms Before any payment for his order and when finalizing it according to the terms described in Article 3, the Customer is invited to choose several delivery terms, different carriers in particular and different prices. Details specific to each of these deliveries are available on the Site. The Customer is informed that he can find this information specific to delivery at any time on the Website and independently of any order under the section dedicated to delivery. The Customer is then bound by his choice of delivery which “les bandemies bio” undertakes to respect. Also, the Customer is aware that depending on the choice of delivery method, delivery times may vary. 

8.3  Price of delivery The price of delivery of the Products is indicated, for each Order, on the Website, as well as in the Order confirmation email sent by “Les allées Bio” to the Customer. This price may vary from one Order to another, depending in particular on the amount and the place of delivery. Depending on the amount of the Order placed, mentioned on the Website, “les allées bio” offers the amount of delivery to the Customer. 

8.4  Place of delivery The delivery address is that indicated or confirmed by the Customer at the time of confirmation of their Order. “Les girlfriends bio” delivers parcels everywhere in France, Monaco and Corsica, including abroad. Monitoring by the Customer of the delivery is possible on the Website. Each delivery is deemed to have been made as soon as the package is made available to the Customer, in particular by the carrier, as evidenced by the control system used by the carrier. 
Without prejudice to the period available to the Customer under his right of withdrawal defined in Article 9 below, the Customer must check the package upon arrival and make any reservations if necessary, or even refuse the package, if it is likely to have been opened or if it shows obvious signs of deterioration. Reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within three working days following receipt of the Products. The Customer will send a copy of this letter by registered post to “les famille bio”.

Article 9: Right of withdrawal and returns authorized by Les Copines Bio

In accordance with the provisions of articles L. 221-18 and L. 221-19 of the Consumer Code, the Customer has a period of fourteen (14) days from receipt of the order to exercise their right of withdrawal. from "les girlfriends bio", provided that the Products are returned in their original packaging, complete (with packaging, accessories and instructions) and in perfect condition, allowing new marketing. Return costs are the responsibility of the customer. Fees will also be charged if the customer refuses the package. Damaged, soiled or incomplete Products will not be taken back. The Products must be returned within fourteen (14) days following notification to Le Monde du Bio of the Customer's decision to withdraw. This period begins to run at the start of the first hour of the first day and ends at the end of the last hour of the last day of the period. If this period expires on a Saturday, Sunday or public or non-working holiday, it is extended until the first following working day.

It is advisable to return the package by tracked mail, in the event that it is lost during delivery. postal delivery, the responsibility of "les amis Bio" cannot be engaged in this respect.

Refund conditions

In the event of non-receipt of the order within the aforementioned delivery times, for any reason other than force majeure or the act of the Customer, the sale may be canceled at the written request of the Customer, under the conditions provided for in articles L. 216 -2 of the Consumer Code. The sums paid by the Client will then be returned to the Client no later than fourteen (14) days following the date of termination of the contract by the Client, excluding any compensation or withholding.

In the event of unavailability of the Product ordered, the Customer who has opted for reimbursement will be reimbursed for the sums paid no later than thirty (30) days from their payment.

If the right of withdrawal is exercised within the period referred to in this article, only the price of the Product(s) purchased and the delivery costs are reimbursed, the return costs remaining the responsibility of the Customer. The Customer will be reimbursed within fourteen (14) days following receipt of the Products by “les allées bio” at Le Monde du Bio SAS.

The refund will be made according to the payment method used by the Customer when ordering.

“Les girlfriends Bio” reserves the right to cancel and refund all orders placed by a professional.

If the customer refuses the package, fees will be charged and only new, unused, undamaged products will be refunded.

Article 10: Legal and contractual guarantees

10.1  The guarantee of conformity Under the conditions of articles L. 211-1 et seq. of the Consumer Code, the Customer may object to "les Copines Bio" the non-conformity of the Product delivered, whether it is a lack of identity, quantity and/or quality (in particular according to the expected use) in relation to the item sold. The Customer must then return the non-compliant item to “les Copines Bio” by following the following procedure provided for in the section entitled “Satisfied or refunded” on the Website, within the time limits indicated by the procedure. 
The Customer will then be able to request, at their choice, from "Les Comies Bio": either to be delivered an item identical to that ordered, within the limit of available stocks, or to be delivered a quality item and of equivalent price, also within the limit of available stocks, or return the item and be reimbursed within 30 days following the request thus made. In the cases of application of this guarantee of conformity, the costs of returning the Product ordered and delivered to the Customer, as well as the possible delivery of another Product are entirely borne by “Les allées Bio”. In any case, these provisions do not deprive the Customer of the exercise of his right of withdrawal, provided for in Article 9. 

What guarantees do I have when I buy a diffuser or fountain?

We offer a 6-month reseller warranty, valid for all our diffusers and fountains, from the date of purchase.

If you notice that your diffuser or fountain is defective during its warranty period, we invite you to contact Customer Service who will tell you the procedure to follow to file a complaint.
It is important to remember that suppliers require you to keep the original packaging in order to be covered by the warranty.
It should be noted that any product whose failure results from negligence or inappropriate use of the diffuser (disrespect of the instructions for the installation and operation of the product), will definitively void the reseller warranty.

10.2  Legal guarantees relating to fatal defects under the conditions of articles 1641 to 1649 of the Civil Code In the event that the Products delivered to the Customer present a hidden defect, that is to say a defect in the quality of the thing itself even if it does not allow its use, in accordance with the provisions of articles 1641 et seq. of the Civil Code, the Customer will have the choice: either to cancel his Order and to be fully reimbursed for the sums paid and the return costs ( in standard mode), or to keep this Product delivered in return for a reduction in the price, which reduction is set by “Les allées Bio” at its sole discretion. 

10.3  Legal guarantees relating to liability for defective products The Customer may claim the defect of an item purchased on the Website under the terms of the provisions of articles 1386-18 et seq. of the Civil Code. 

10.4  The legal guarantees are applied in accordance with French legislation which “les Copines Bio” undertakes to respect. Consequently, they cannot be applied for any lack of conformity of an item sold, or recognized defect, in foreign legislation in force in a territory in which the Customer would have had his order delivered or would use this product or this service. The information and documents transmitted to the Customer (if applicable) are only in French, as accepted by the Customer when placing an order with "Les Copines Bio". 

10.5  Contractual guarantees Certain Products offered on the Website may also give rise to a contractual guarantee, which is generally the one granted by the suppliers of “les allées Bio”. The provisions specific to this guarantee are then entered on the computer tabs of said site intended to make the qualities of the articles known to the Customer. The Customer cannot request to benefit from a broader guarantee than that provided. In order for the Customer to invoke the contractual guarantee, he or she must contact “Les allées bio” according to the instructions given for this purpose in the Satisfied or Refunded Section. 

10.6  Exclusions of guarantees Are excluded from all benefits of the guarantees mentioned under the terms of the General Conditions of Sale, Products or Services modified and/or repaired by the Customer or having been the subject of use by the Customer not in conformity with their intended purpose . 

Article 11: Returns of Products

Any return of a Product that the Customer wishes to make in execution of the provisions of Articles 9 and 10 above, must be made exclusively by post via the post office to the following address: "les bandemies Bio" at Le Monde du Bio 15, rue René Cassin, 37390 Notre Dame d'Oé, where our logistics warehouse is located. 
The return of a Product by So colissimo my post office or by So colissimo my merchant is impossible. Only returns by mail via the Post Office will be accepted by “Les allées Bio”. Any parcel returned by another method and which is lost will not be exchanged or refunded by “les famille Bio”. 

No complaints regarding non-receipt of a package will be accepted by our services beyond one month after shipment.

In the event of a visibly lost package, no compensation can be granted before the outcome of an investigation by the carrier (up to 30 days after opening of the investigation by our services).

If the customer refuses the package, fees will be charged and only new, unused, undamaged products will be refunded.

Article 12: Loyalty program

“Les girlfriends Bio” may offer the Customer a loyalty program. The conditions and terms of application of this loyalty program are specified on the Website. These offers and the conditions under which the Customer can benefit from them will be specified on the Website. This loyalty program can take the form of vouchers offered to the Customer by "les famille Bio" for each order above a certain purchase amount specified on the Website. 

Article 13: Personal data

13.1 “Les allées bio” undertakes to respect the confidentiality of Personal Data communicated by Customers on the Website and to process them in compliance with the Data Protection Act of January 6, 1978. 

13.2 “Les allées Bio” informs the Customer that their Personal Data will be used by its internal services for the processing of the Customer's Order and to reinforce and personalize communication, in particular through information letters/emails as well as within the framework of personalization of the Website according to Customer preferences. Bio Santé Senior sarl may also provide its partners with consolidated statistics relating to its Customers, sales, trade structures and other information appearing on the Website to trusted third parties, but no Personal Data will be transmitted to third parties without express authorization of the Customer. 

13.3 “Les allées Bio” informs the Customer that it may however communicate this Data to ensure the delivery of Orders by its service providers (carriers), or for the needs of after-sales service. In addition, “les famille bio” may also communicate this Personal Data to respond to an injunction from administrative or judicial authorities. 

13.4  When creating or consulting their Personal Account, the Customer may choose to receive information and commercial proposals from 'less girlfriends Bio' by email. 

13.5 In addition, in accordance with the Data Protection Act of January 6, 1978, the Client may exercise, under the conditions referred to in article 40 of the aforementioned Law, his right of access to the file, his right of opposition and his right of rectification or deletion for information concerning him by sending his request (indicating e-mail address, surname, first name, postal address), by e-mail to the following address [email protected] or by going to the Website of www.lescopinesbio.com, in the “Contact us” section via the contact form or by post to the following address: “Les bandemies Bio” Samopar 9 avenue Albert II 98000 Monaco.

Article 14: Publication of opinions, comments and observations

The Customer has the possibility, at the time of an Order on the Website, to publish an opinion, a comment or submit a suggestion to the company "les Copines Bio", on the services offered by it and/or, more specifically, on the Product or Service purchased. These observations must be written by clicking on the “Write a review” link present alongside the presentation of each of the Products. 
This content must not be illegal, obscene, abusive, threatening, defamatory, nor infringe intellectual property rights, or be harmful to third parties. It cannot constitute or must not contain computer viruses, political activism, commercial solicitations, mass mailings, chains or any other form of "spam". The company “Les allées Bio” reserves the right, at its sole discretion, to remove or modify all or part of the Customer's comment or opinion.

Article 15: Miscellaneous

15.1  In the event that any of the terms of the General Conditions of Sale are considered illegal or unenforceable by a court decision, the other provisions will remain in force. 

15.2  In application of articles 1316 et seq. of the Civil Code, the information provided by the Website is authentic between the parties. Elements such as the time of reception or transmission, as well as the quality of the data received, will be taken into account by priority and as recorded on the information systems, or as authenticated by computerized procedures, of “Les Copines Bio”, unless the customer provides written proof to the contrary.
The scope of the proof of the information delivered by the computer systems of “les Copines Bio” is that which is granted to an original in the sense of a paper document written and signed by hand.

Article 16: Law – Dispute

These General Conditions of Sale in French will be executed and interpreted in accordance with French law. In the event of a dispute likely to arise in connection with these General Terms and Conditions, their interpretation and their consequences or with the acts supplementing or modifying them, the Customer will contact “les famille Bio” as a priority to obtain an amicable solution. Failing this, express and exclusive attribution of jurisdiction is made to the competent courts within the jurisdiction of the Monaco court, notwithstanding plurality of defendants, warranty appeal, summary proceedings and expertise for all disputes.
